The High Court on Sunday granted six weeks anticipatory bail to Rajshahi mayor Mosaddek Hossain Bulbul after he had surrendered in the court seeking bail in four cases relating to violence during countrywide blockade in January.
A bench of Justice AKM Asaduzzaman and Justice Md Iqbal Kabir also directed the government and the police to explain why Mosaddek Hossain would not be granted regular bail in the four cases.
The bail order paved the way for BNP-back mayor Mossaddek Hossain in attending office as he was not wanted in any other case, said his lawyer Badiuzzaman.
On Thursday, another bench of Justice Mirza Hussain Haider and Justice AKM Zahirul Hoque stayed for a month the local government division’s order issued on May 7 suspending Mosaddek Hossain as mayor after he had been charged in four other cases.
The bench had also directed the government to explain why the section 12(1) of Local Government (City Corporations) Act 2009 under which Mosaddek Hossain had been suspended would not be declared unconstitutional.
The bench had passed the order after hearing a writ petition filed by Pro-BNP-backed mayor Mosaddek Hossain challenging the legality of his suspension and the law.
